These Terms of Use ("Terms") govern your access to and use of the Platform. By accessing or using medtopdoc.com, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

The Platform is a purely informational website. It is not a marketplace, a medical directory service, a consulting portal, or a provider of any professional services. CB & Partner Consulting GmbH (the "Operator") operates the Platform for informational and educational purposes only.

The Platform does not provide medical advice, medical opinions, diagnoses, or treatment recommendations of any kind.

All content published on medtopdoc.com — including but not limited to articles, doctor profiles, specialty descriptions, medical history features, Academy courses, and any other materials — is provided for general informational and educational purposes only. No content on this Platform is intended to substitute for:

• professional medical advice from a licensed physician or healthcare provider;
• professional medical diagnosis;
• professional medical treatment or care;
• the judgment of any qualified healthcare professional.

Always seek the advice of your own physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read on this Platform.

The Operator does not recommend, endorse, or refer any specific physicians, medical procedures, treatments, pharmaceutical products, medical devices, or clinical opinions. The Platform features profiles of medical professionals ("Doctor Profiles"). These profiles are presented for informational purposes only and are subject to the following important limitations:

• Doctor Profiles do not constitute a recommendation, endorsement, or certification of any physician.
• The designation "Top Doctor" or "Medical Top Doctor" is a brand name and editorial designation used by the Platform. It is not a certified quality label, an official title, a medical board certification, or a regulatory endorsement of any kind.
• The Operator does not independently verify the medical qualifications, licences, board certifications, specialisations, or professional standing of any physician featured on the Platform. Profile information is compiled from publicly available sources and, where applicable, self-reported data, and may be incomplete, outdated, or inaccurate.
• Inclusion on or exclusion from the Platform does not imply any judgment regarding a physician's competence or quality of care.

Users are solely responsible for verifying the qualifications of any physician before seeking medical services. The Operator accepts no liability for decisions made based on Doctor Profiles.

Nothing on the Platform constitutes a legally binding offer (Angebot) within the meaning of German civil law. All content is provided as general information without obligation.

Any contact forms, inquiry forms, or similar interactive features on the Platform serve exclusively as a means for users to express non-binding interest. Submission of a form does not create a contractual relationship between the user and the Operator, nor between the user and any physician featured on the Platform.

The Operator does not provide medical, legal, financial, or any other professional consulting services through the Platform. CB & Partner Consulting GmbH's own consulting activities are entirely separate from and unrelated to the informational content of medtopdoc.com.

The Platform may feature educational content under the "Academy" section, including articles, course descriptions, webinar summaries, and related materials. All such content is provided for general informational and educational purposes only.

Unless explicitly stated otherwise for a specific program, Academy content does not constitute accredited medical education (CME/CPD), and completion of any Academy content does not confer medical credentials, professional certifications, or continuing education credits.

This Platform does not advertise or promote specific medical treatments, pharmaceutical products, or medical devices within the meaning of the German Heilmittelwerbegesetz (HWG — Medicinal Products Advertising Act). All content is editorial and informational in nature.

The content on the Platform is compiled with reasonable care. However, the Operator does not warrant or guarantee the accuracy, completeness, timeliness, or reliability of any information published on the Platform.

Liability cap: To the fullest extent permitted by applicable law, the Operator's total aggregate liability for all claims arising out of or in connection with the use of the Platform shall be limited to EUR 500.00 (five hundred euros).

This limitation of liability does not apply to:

• damages caused by wilful misconduct (Vorsatz) or gross negligence (grobe Fahrlässigkeit) on the part of the Operator, its legal representatives, or its agents;
• injury to life, body, or health;
• liability under the German Product Liability Act (Produkthaftungsgesetz);
• any other liability that cannot be excluded or limited under mandatory provisions of German law.

The Operator shall not be liable for any damages resulting from reliance on information published on the Platform, including but not limited to medical decisions, treatment choices, or physician selections made based on Platform content.

All content on the Platform — including but not limited to text, images, graphics, logos, the medTopDoc wordmark and design, page layouts, software, and compilations — is protected by copyright and other intellectual property laws. The content is owned by or licensed to CB & Partner Consulting GmbH.

The designations "medTopDoc", "Medical Top Doctors", and related branding elements are proprietary to the Operator. Unauthorised use, reproduction, or imitation is prohibited.

Users may view and download content for personal, non-commercial informational purposes only. Any other use — including reproduction, distribution, modification, public display, or commercial exploitation — requires the prior written consent of the Operator.

You agree to use the Platform only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the Platform by, any third party. Prohibited conduct includes but is not limited to:

• automated scraping, crawling, or data extraction beyond what is permitted by our robots.txt file;
• attempting to gain unauthorised access to any part of the Platform, its servers, or connected systems;
• using the Platform to distribute malware, spam, or other harmful content;
• misrepresenting your identity or affiliation when submitting forms or contacting the Operator;
• using Platform content to create competing products or services without written permission.

The Platform may contain hyperlinks to websites operated by third parties. These links are provided for informational convenience only. The Operator has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites.

The inclusion of a link does not imply endorsement of the linked website or its operator. Users access third-party websites entirely at their own risk. The Operator is not liable for any damages or losses arising from the use of third-party websites reached via links on the Platform.

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data, including through the use of HubSpot, Google Analytics, Google Tag Manager, and Google Ads. Please review the Privacy Policy for full details.

By using the Platform, you acknowledge that you have read and understood the Privacy Policy. Non-essential cookies and tracking scripts are loaded only after you have given your consent.

The Operator reserves the right to modify or update these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the Platform after any modification constitutes your acceptance of the revised Terms.

We encourage you to review these Terms periodically. Material changes will be indicated by updating the effective date at the top of this page.

These Terms and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG) and conflict-of-law provisions.

The exclusive place of jurisdiction for all disputes arising from or in connection with these Terms shall be Munich, Germany (Landgericht München I), to the extent permitted by law.

The European Commission's Online Dispute Resolution (ODR) platform, previously available at ec.europa.eu/consumers/odr, was discontinued as of July 2025 and is no longer available.

In any event, medtopdoc.com is a B2B-oriented informational platform and does not enter into consumer contracts. The Operator is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle) pursuant to the German Consumer Dispute Resolution Act (VSBG).

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely achieves the economic purpose and intent of the original provision (salvatorische Klausel).
